Multilingual Education Essay

In the long years of educating children, the school and the curriculum designed to use Filipino and English as a medium of instruction. Although English is a foreign language, we use it to serve as our language especially communicating and expressing ideas. By using it, we are being globally competitive that we can align in other countries. And to show also that we are not behind among the competitive countries worldwide in the field of education. Filipinos were considered smart and flexible as we can easily learn foreign language. However in the long time of using it, not all may have the skill to understand and speak it. Those other children could not express their ideas freely because they find it difficult. Sometimes it leads them to have a low self-esteem. One of the changes in Basic Education Curriculum brought about by the new K-12 program is the introduction of Mother Tongue- Based Multilingual Education (MTB-MLE) specifically in Kindergarten, Grades 1, 2 and 3 to support the goal of â€Å" Every Child- A- Reader and A –Writer† by Grade 1.† Multilingual Education typically refers to â€Å"first-language-first† education that is, schooling which begins in the mother tongue and transitions to additional languages. It is meant to address the high functional illiteracy of Filipinos where language plays a significant factor. Every area has different lingua franca, the most common language in an area. Mother tongue means we are using the language in our community. The language you already heard and used by the people around. It’s the language that was used in daily conversation with the family and neighborhood. We use our own dialect as we say. During kindergarten and Grade One the child starts to learn how to read. During this stage, they struggle to learn reading. Not all are fast learners; some are poor because they could hardly recognize words especially in English. In this stage they need follow up in school and at home. Many children are found to be poor-readers and having difficulty to comprehend stories and paragraph. That is the common problem in school. A child who suffers this situation became passive and doesn’t want to go to school anymore. When the teacher is having a discussion, a child will not participate and afraid to commit mistakes in answering because they don’t know how to express their answer. The mother tongue was implemented because many children are not comfortable using foreign language as medium of instruction. A child could not express an idea if it is in English because other children find difficulty to use it. Mother Tongue will serve as a foundation to learn Filipino and English easily. Starting kindergarten, the children will use mother tongue. They will learn their lesson using stories, poems, illustrations based on their local culture. Learning will be continuous to the child as they use their own language. They will express ideas freely and have confidence within themselves. It is easy for them to construct sentences, make paragraphs as they identify the terms use. Easy to converse and recite because the words use are familiar and they use it every day. They would count numbers, sing songs, recite poems in the language use in the community. Understanding occurs instantly in them. Studies show that students learn better when taught in their native language than in a foreign tongue. Through the use of the mother tongue, it will develop their reasoning skills and higher thinking skills of the students. Pupils can easily express their different views and ideas during class discussion. Further, students will understand their lessons better; at the same time infuse a sense of nationalism and they will also gain fluency in their L1. MTB-MLE benefit pupils because they easily understand their lessons and the learning skills of students can be easily achieved. The objective in lessons of the teachers can be achieved as pupils comprehend well. They can understand what the teacher is talking in front. They can give examples and interact well in discussion. Their self-esteem develops and confident to deal with the lessons. It is easy to the teacher to establish rapport among her pupils. We are also promoting nationalism because we use the native language rather than the foreign language. If there are benefits we get from this, there are also disadvantages. The implementation of MTB-MLE will demand more time to translate books into different dialects knowing that Tagalog is not the only dialect that Filipino people speak. In different areas in the Philippines, we use different dialects so it will take more time to study and translate it to our own dialect. I find it difficult to other pupils who are transferee .If they come from a school where they had different language use, they will find it hard because they need to adapt and study the dialect of that particular area in order to communicate. It will create confusion also on the side of the child due to different terms use. Example if a child came from Cebu then transferred to Iloilo. Cebuano’s language is different to Hiligaynon. So a child does not know the words to speak or might his/her classmates laugh at him/her. Maybe the child can speak words that had different interpretations to that certain place and could create misinterpretation. And also in Iloilo we have different languages use in every town. We have different versions of Hiligaynon. And every word has different meanings. It would cause misinterpretations and confusions. Because some words are easy but other words are very difficult to understand even it is in Mother Tongue. It is also difficult for those who are comfortable using English as their medium of instruction. They are used to speak and use English well so they could not comprehend well in the Mother Tongue. They become confuse what are the exact words to use when it is translated in Mother Tongue. And some pupils who studied their kindergarten from private schools whose instruction is on English will find difficulty interpreting the translation of the subjects in Hiligaynon because they are not used by it. Sometimes they could not get the instructions well. Their performances were affected of this language acquisition. Another problem with Mother Tongue is when children already familiarized with it, they will be poor in speaking English. They will less prioritize the use of it. They would only stick to mother tongue because it’s the only easiest language for them in order to communicate. Hope that all the programs that were implemented will pave way to an improved and quality education no matter what language should be use as an instruction. And all children will be given equal opportunity to avail the quality of education that the government offers. That will help to lessen non-readers and poor readers of the country. That Mother tongue will make the lessons easy for every child in recognizing and comprehend to lessons and stories. That they will learn to express their ideas well and eliminate illiteracy and become fast readers in the future.

Martin Luther was the most influential person of the 15th and 16th century the reason being he rebelled against the catholic church the highest authority in the world at that time. When Martin Luther went against the church he not only reformed Christianity but reformed every person in Europe into a thinking human being. So when looking at the most influential people of the time Martin Luther paved the path for all modern sciences. Martin Luther’s Ninety Five Theses showed obvious faults and corruption throughout the Catholic Church. When looking at Martin Luther’s ideals he showed that the Catholic Church had made up rules that could not be found in the bible. Due to this finding he led the Protestants into a more direct translation of the bible. One of his largest accomplishments was the translation of the bible into the German language. By translating the bible out of Latin and into German he placed the interpretation of the word of god into the hands of people who had been simply told god’s word from a Catholic stand point. By shining light on the problems of the Catholic Church Martin Luther created a wave of people with minds of their own. By giving people a reason and the power to think for themselves he lit the powder keg for the exit of the middle ages and entrance into the renaissance and the scientific revolution. And when looking at the scientific revolution one can speculate that if Martin Luther’s Protestant reformation had not taken place when it did the Catholic Church would most likely have crushed any new scientific ideas that did not conform to the teachings of the church. To prove that the speculation has weight one can look at how the Catholic Church employed major censorship of the Protestant teachings. Martin Luther was the most influential person of the 15th and 16th century because he shined light upon the power of the human mind. By empowering people he gifted the world with the spark that led to the scientific revolution and the split of the Catholic religion.

Film versions of Romeo and Juliet Essay My aim of this essay is to compare the two versions of Romeo and Juliet that are directed by Baz Lehrman and Franco Zeffirelli. Lehrman set his in modern times with modern clothing and buildings. He still uses early modern English but with some lines changed, so the modern audience can understand the story a little easier. It was created in 1996. It is given a Miami beach setting with loud music and super-artsy sets, reviewers said Natural born killers meet Stratford-Upon-Avon, a kind of Shakespeare MTV. This version definitely helped younger people with the understanding of the play, and to appreciate the works of Shakespeare, simply because Lehrman could keep to the main basis of the story, yet modernise it to suit these recent times, and keep the audience interested throughout the whole of the film. It was certified as a twelve. Zeffirelis version is set in Elizabethan times in Italy. At the time that this film was created it was the first version of Romeo and Juliet where the two main characters were played by actual teenagers (seventeen and fifteen). He created the latest action, humour and romantic film version of Romeo and Juliet yet. It was shot in Italy in three main cities of Tuscany, Umbria, and Lazio, but all the scenes of riot and duelling were shot in Gubbio. It was certified as PG. Both of the opening scenes begin with the famous chorus Two households both alike in dignity This gives you a basic outline of the story although it isnt clear. Zeffirelli had a male voice talking with the same tone of voice throughout it, it was a fairly plain tone but had the hint of sadness as well. On the screen all you can see is a border surrounding the town at the edge of the screen in orange and yellow swirls giving it an ornament look. There is a birds eye view moving across the town then through it, the camera moves very slowly and appears almost like an introduction to the town and gives a sense of romance and anger. The romance because of when the shot is in the town centre it pivots towards the sun it makes you think of happiness and love. Anger, because of the mist right at the beginning and the dark shadows of the walls when the camera goes down fairly dark alleyways. There is folky and old aged music throughout it, this gives you a head start in knowing there will be old fashioned buildings and costume, this creates an image of the Shakespearian times and recall over the whole story of Romeo and Juliet. Lehrman begins with a television set and a pitch black background with the T.V screen fuzzy at first then with someone channel hopping giving you the directors name an the production team name. It is completely silent with only the sounds of the remote control flicking over the channels. Then there is a newscaster announcing the news/story of Romeo and Juliets death. She is reading the chorus which is read at the beginning of Franco Zeffirelis version. As she is talking the camera very slowly zooms into the screen. Then just as she reads the last line the camera zooms in very quickly into the blue background on the T.V screen. Then very loud opera music is played. This gives you a sense of danger maybe violence, the camera zooms down a long road through the town, I think this might have been influenced by the last line Is now the two hours traffic of our stage as the word traffic stands out. Then there are flashes of the scenes throughout the movie mainly of violence. The chorus is repeated this time by a male voice. There are pictures of newspaper articles and main words like Two star crossed lovers take their life this is to point out main themes of the story. There is also displays of the white dove and sacred heart labelling Catholicism. The party scene in Zeffirelis in some ways is different but also similar to that in Lehrmans, like when the pair talk to each other there is a solo being sung in the background or on-stage both romantic songs to set the scene for when the pair fall in love. In Lehrmans you have the vision of Romeo who is on drugs, so there is a lot of spinning camera work to show the works of ecstasy also it changes from one thing to another like when Romeo is talking to Lord Capulet then the next moment he sees him singing also the appearance of Mercutio singing and dancing. Later he is looking into the fish tank and there he sees Juliet on the other side of it. He instantly takes an interest in her beauty and follows her over. Then Juliet dances with Paris but keeps an eye out for Romeo. When the dance is over there is a huge celebration when Romeo grabs Juliets hand and they begin to talk then the camera shows what Juliet is seeing when Paris turns around ands laughs. Later when they are in the lift together the camera slowly moves around them whilst they kiss to get all sides of them both, it does this about two times I think they do this because its such a passionate moment that Lehrman wanted to make it last as long as possible. In fact its done twice once when they get in the lift and then again when they run out of the lift then back in. When the nurse comes to get Juliet she gives Romeo an evil look, which he doesnt understand at first until he realises that she is Capulet, the music quietens and the camera holds long time shots at both their faces also when Juliet finds out Romeos a Montague, this creates a lot tension. In Zeffirellis he chose to get Romeo to see Juliet before she sees him whilst she is dancing. Soon Juliet spots him and she takes an interest. Zeffirelli chose to get them to meet through a dance called the moreska. Here they dance together they dont actually talk but you can see in their faces they begin to fancy each other. At this section just like in Lehrmans there is a lot of spinning camera work especially when there are two circles dancing it shows flashes of Lord Capulet, Romeo, Juliet, and of the entire room which they are in. When it finishes a soloist comes on stage and every one creates a circle round him, Romeo and Juliet try to find each other and when they do Romeo grabs her hand and talks to her. Later they kiss and the camera pauses on them whilst there is no singing in the music this makes it fairly romantic but I think it would have been a bit better if the camera looked up and down them to show they are really falling in-love. When the nurse takes Juliet away she asks the nurse to find out who Romeo is. Also Romeo finds that Juliet is a Capulet here, as well as Juliet finding out that he is a Montague. Both directors chose to hold the camera on the couples first kiss. I think they chose this because it really creates a romantic atmosphere this helps people to see the passion between each other. Also they chose to get Romeo to grab Juliets hand from behind a column, this makes him appear like the no fear type, the type who are not scared to jump into things like here he instantly tries to impress her with holy palmers kiss. Difference Between Criminal And Civil Procedure Law Essay Law is a set of general rules which are created by a superior entity in order to regulate human behaviour and maintain justice and peace in the society. Law applies to everyone living in a particular territory  [1]  . There are as many legal systems in the world as countries, but for academic reasons we classify them into three main categories: Continental (Civil, Romano-Germanic) legal system, Common (Anglo-American) legal system and Religious legal system. Law can be split up in different branches such as, Criminal law, Civil law, Commercial law, etc. In this essay I will discuss the differences between Criminal and Civil procedure in Continental and Common legal system. Continental legal system is the oldest and most widely implemented legal system in the world. It derives from Roman law, Canon law and Commercial law. The Roman law started its contribution by the XII Tables which were published in 450 B.C. Later in the year 530 Justinian codified Roman law by publishing Corpus Juris Civilis. According to Justinian Roman law consisted of Ius Civile the body of laws which applied to local citizens, Ius Gentium the laws which applied to foreigners and Ius Naturale the body of laws that were considered common to all human beings  [2]  . The Canon law was developed by the Church in order to administrate and monitor the rights and obligations of the people. The needs and interests of merchants lead to the development of Commercial law. The historical sources of concepts, institutions, and procedures come from these three sub traditions. Today it is dominant in most parts of Western Europe, all of central and South America, many parts of Asia and Afric a. Continental legal system has influenced the laws of specific nations, the law of international organizations and international law. The main feature of this legal system is that all the laws are codified (i.e. written down). Common Legal System: The Common law system is one of the most influential legal systems of the world. Before 1066 in England there was no legal system, instead it was based upon oral customary rules, which varied from region to region. In 1154, Henry II institutionalised common law by establishing a unified court system which was common to the whole country. The common-law system exists in England, the United States, and other countries which were colonized by England. This makes it one of the most widespread legal systems in the world. Common Law system is mainly based on the case law or judicial precedent, this system doesnt use legislation as a primary source of law instead legislation for them is a clarification of legal rules and principles which are essentially derived from case law/judicial precedents. In this type of legal system law is developed on a case-by-case basis. In the common law system the solution to a case becomes a part of the law. This concept is known as Stare Decisis. Difference between Common and Continental Legal system: In the Common legal system the judges have very broad interpretive power. However in the Continental legal system the judges serve as civil servants who receive salary and belong to an organization of judges  [3]  . In Continental legal system all the laws are written and codified, and unlike Common legal system they are not determined by the judges. Instead they are determined by the parliament. Legislation is the primary source of law and the court system is not adversarial (i.e. the judge takes an active part in the hearings/trials). Also in the Continental legal system any updates to the laws must be made through legislation or some other long process. While in the common law system laws can be changed/updated by single rulings. This allows the common legal system to develop faster than the continental legal system. In the Continental legal system there is a major difference between public and private law. Private law includes the rules governing civil and commercial relation ships, whereas Public law consists of matters that concern the government. Similarly in Common legal system there is a difference in private and public law; however the process is slightly different. Substantive and Procedural Law: There are two main categories within law known as substantive law and procedural law. Substantive law deals with creating and defining the rights and obligations of individuals and parties. It refers to all categories of public and private law. On the other hand, procedural law is the body of legal rules which regulates the process of determining the rights and obligations of parties. Procedural law is also referred to as adjective law  [4]  . It is made up of state or federal statues, rules proclaimed by courts and standards established by constitutional law  [5]  . Common legal system pays more attention to procedural law than to substantive law. However, substantive law plays a vital role in Continental legal system. Criminal Law and Procedure: Criminal law is the body of rules and statues which define the conduct which is prohibited by the state/government because it may harm the society/public. It is a welfare that establishes punishment which will be imposed if this law is broken. Criminal procedure states the rule under which criminal cases are conducted. It involves investigation, prosecution, adjudication and the punishment of the crimes. A regular criminal proceeding, in the Continental legal system, is divided into three main parts: the investigating phase, the examining phase and the trial. The public prosecutor conducts the investigative phase and also takes an active part in the examining phase, which is supervised by the examining judge. This phase is mainly written and it determines whether there is a need for a trial or not  [6]  . The trial is a relatively brief and informal affair conducted by a judge without a jury. The defendant does not necessarily have the right to keep silent. Sometimes the trial do es not require all the witnesses to be present and may last in excess of a year. On the other hand, in the Common legal system a criminal proceeding starts with a police investigation which is aimed at collecting evidence that will prove the defendant guilty. Then an adversarial trial is conducted before either a judge or a jury. The attorneys conduct the trial and try to convince the judge in their favour. The trial is continuous and the evidence against the defendant must be presented by live witnesses in court. One of the basic differences in criminal procedure in Common legal system and Continental legal system is that, the judge in Continental legal system plays a more active role in determining the facts of the case (i.e. takes an active part in the proceedings) while the contrary is true for Common legal system. Also, the continental legal system relies more on written argument than on oral argument. However, in the common legal system everything in the trial is primarily oral. Civil Law and Procedure: Civil law is the body of rules that delineates the private law (e.g. contract law, property law, family law, etc.). It is opposed to criminal or public law. Civil procedure is the body of law that sets out the rules and standards that courts follow while judging civil lawsuits (i.e. non-criminal matters). It administers how a lawsuit/case will be carried out (i.e. the whole process). It is a general part of the private law and can be exercised by anyone to impose, redress or protect their legal rights. In the Continental law civil procedure is found in codes, whereas in the Common legal system it is found in rules of court made under statutory powers. Historically, in the Common legal system civil procedure lawsuits included a jury and a judge. The matter of law was reserved for the decision of the judge and the matters of fact for the jury. Even though, this practice is greatly discontinued in most of the modern Common legal countries the United States still employ it. The litigatio n is commenced by means of a document drawn up by the claimant which is then validated by the court. Hereafter, pleadings are followed by disclosure (i.e. disclosing evidence to the other party). Trial is usually lead by a hearing in which problems arising in pretrial procedure might be determined and attempts to compromise are made. In Continental legal system trial by jury is unknown and the litigation is usually conducted by a multijudge court. The issues of law are often determined by a series of hearings. The prominence is more on written evidence than on oral presentation  [7]  . Difference between Criminal and Civil Procedure: In criminal lawsuits, the litigation is always filed by the state, whereas in civil lawsuits a private party files the litigation and becomes the claimant. In criminal lawsuits a guilty defendant is punished by either imprisonment, fine paid to the state or death penalty (exceptional cases). On the other hand, the losing defendant in civil lawsuits is generally supposed to reimburse for the losses caused to the claimant. In criminal lawsuits the burden of proof is always on the state (i.e. the state must prove that the defendant is guilty), since the defendant is assumed to be innocent until proven guilty. However, in the civil lawsuits the burden of proof is initially on the claimant, but in some cases it shifts to the defendant. In criminal cases the defendant is protected by a number of protections which are specified in the constitution (or legislation). But in civil cases there are no protections offered to defendants. Another difference between criminal and civil lawsuits is th at, criminal cases have to be proven beyond reasonable doubt. Civil cases only have to be proven on the balance of probabilities  [8]  . It can be seen that there are many differences in the Common legal system and the Continental legal system. These differences exist not only in their historical background but also in their approach to legal matters. I personally believe the procedures are flexible and the parties to the case enjoy more rights and obligations in Common Law system, since the Judge refers to a previously held similar cases and the legislation is not codified. As we know, there are clearly many differences between Common and Continental legal systems, however it should be noted that in the recent times both systems have started to converge in their use of the sources of law. As De Cruz (1999) mentions, in the recent times the English legal system has started to give more significance to legislation. On the other hand the Continental legal system has also started to rely on precedents, especially in German constitutional and French administrative courts. Thus, this leads us to think that there is a possi bility of the legal systems converging together. This concept is known as the Convergence theory. This might be possible in some aspects, however not completely because of the enormous difference in ideology, social and economic policies, morality and many other things.

Funding a United States Space Program It is imperative that the United States government should put forth a better initiative regarding our flailing national space programs, and increase their budgets considerably, stressing modification on its goals, modification of its resources, and for overall further advancement of its scope and capability. The space program had been heralded for years as the pride, and future, of the United States. Its promise brought hope to a society plagued by fear and competition, and has since been both the impetus for both immense technological competition, and then conversely, a symbol of cooperation between two diametrically opposed cultures. It brought numerous breakthroughs in medicine, materials science, engineering, and defense—over 30,000 advancements to date, including MRIs and CAT scans for detecting cancers and other health threats. Why does our government choose to slowly phase out the life of an entity that has only but added years to our own? The space program is an import ant part of our existence as Americans, and as world citizens.   Ã‚  Ã‚  Ã‚  Ã‚  The space program needs the appropriate funding for modification for fundamental purposes. The program has worked with the same prototype rocket for almost 50 years. New breakthroughs have emerged in planning and research; however the program does not have the means to go about implementing new ideas. With advancements created through space science research, such findings could create better means of travel on Earth. Also, space exploration gave us the first stark warnings of a world damaged by our endangerment of the environment, and it could further nurture the repair of our planet by allowing us to find better ways of utilizing our resources.   Ã‚  Ã‚  Ã‚  Ã‚   Space travel and exploration is needed for social purposes. Since we do not truly know what can be ‘out there’ awaiting us, both living and nonliving, it is important that we are prepared as a race to face them, in case a need or emergency arises in which we are forced to. Space travel concentrates on an investment in the betterment of humanity as a whole, and by so doing, it presents to the world the idea of our maturity as a race.

Comparing Jane Eyre and Yellow Wallpaper -- Comparison Compare Contras

Similarities Between Jane Eyre and Yellow Wallpaper   Ã‚   There are notable similarities between Charlotte Perkins Gilman's The Yellow Wallpaper and Charlotte Bronte's Jane Eyre. These similarities include the treatment of space, the use of a gothic tone with elements of realism, a sense of male superiority, and the mental instability of women. There is a similar treatment of space in the two works, with the larger, upstairs rooms at the summer lodging and at Thornfield Hall being associated with insanity and the smaller rooms below being safer and saner. Gilman's narrator expresses an early desire to move downstairs to a smaller, saner room, but her wish is ignored. Large rooms become haunted rooms in both stories as typified by the room with the yellow wallpaper, the Red Room, and the third floor room beyond which Bertha is confined. Both works contain gothic elements, but there is a conscious effort on the part of both narrators to dispel the gothic tone with elements of realism. Gilman's narrator begins to describe her eerie summer lodgings, but notes "there was some legal trouble with the heirs and co-heirs... That spoils my ghostliness, I am afraid" (11). Jane likewise is both affected by and resists the supernatural. For instance, she notes along with Grace Poole's fantastic laughter, her affinity for beer. However, the most notable similarity between the two works is the presence in each house of a "madwoman in the attic" (to borrow from Gilbert and Gubar). In the case of Gilman's narrator (unnamed, but with one ambiguous reference that it may be Jane) and Bertha, madness id the result of traditional Victorian marriages, from which both transgress. Corrections Trend Evaluation Essay

This paper explains the many trends in the public and institutional criminal justice system. These trends, starting from the past, push the research into the present and future with the implementation of continuing trends and perspective ideations to aid in the progress and advancement of criminal procedures. This paper starts with the history of community and commercial criminal justice and attaches the proceedings to the present-day standing. This paper also shows an idealistic and theoretical analogy of how the criminal justice system may look in the future based on current trends. Past Trends Stories mentioning jails are throughout history even back to biblical times, however, America did not have an official penitentiary until 1790 at which time Philadelphia constructed the Walnut Street Jail. It was during this time that the root word of penitentiary took on its new form. Prisoners in early times were sent with the aim of the punishment in the form of penance, thus with any luck resulting in purity of personal reform. Inmates are kept in single cell units at all-times, even for meals. Recreation was not an option. In the rare event, that an inmate did leave the cell, a mask, or hood is required (Johnson & Dobrzanska, 2005). The goal is to lead a monk style life, thus providing a Bible to all inmates is mandatory, and it is a hope that the offenders would spend their sentences preparing to live law-abiding lives as governed by God’s word, following their release. This type of containment for inmate is known as the separate system. On the flipside of the separate system is the congregate system, and the first notation of its use, is by the Auburn Prison (Johnson & Dobrzanska, 2005). Prisoners still lived a life of confinement while in their cell, but with this system, they coexist with other inmates for work and meals. Although this is a change, inmates never speak a word and many recall the only sound coming from workshops within the prison and the marching of inmates (Johnson & Dobrzanska, 2005). Present Trends Much has changed following the days when inmates donned masks or hoods just to walk down a corridor within prisons walls. Prior to the 1960s, both the public and the courts developed a â€Å"hands off policy† toward the conditions and practices within criminal facilities (Martin, & Katsampes, 2007). The reasoning behind this was a notion that correctional administrators knew how to best control both inmates and correctional facilities. However, during the 1960s and the 1970s, while people outside were rallying for civil rights of different groups of people, inmates were inside prisons rallying for prisoners rights. At this point, the criminal justice system and treatment of inmates take a poignant turn in history. The decision of the courts allowed the trend to move from inmates living a monk style lifestyle to inmates who currently have access to courts, counsel, mail, more choices for reading material and libraries, medical care, food services, recreation, exercise, and due process. Because of this society now, see’s correctional facilities were inmates coexist around other inmates, as well as seeing inmates legally counseling other inmates in their cases as well as appealing and representing themselves in court. We have TV crews going into facilities and providing the public with firsthand accounts of life within the jails. However with the changes come downfalls in the goals for incarceration. No longer is the goal one of penance, it has since changed to a goal of punishment. The focus is holding an offender accountable for illegal acts as well as a means to discourage offenders from committing future criminal acts, and with any luck discourage others in communities from following in the same tracks as current inmates. Because of this trend, the judicial systems as well as correctional facilities have increased to a level of concern. Another unfortunate outcome of the changing of times comes the changing of the importance behind rehabilitation. According to Martin, and Katsampes (2007), rehabilitation, and reintegration rank as secondary goals. Noted, especially for this theory are the jails, as they do not attempt to provide inmates with opportunities for self-help or change to deter future criminal behavior. Luckily, community-based corrections are stepping up to assist in the rehabilitation of offenders. Programs such as community-based centers are offering their assistance in reintegrating inmates back into society. These types of centers operate within a private sector and offer assistance in areas, such as returning to school for finding employment as well as enrolling the participants into classes such as cognitive self-changing classes, parenting classes as well as drug and alcohol programs. Another example of community-based corrections focuses on alleviating the overcrowding issues seen within the correctional facilities. These programs encompass opportunities such as bail supervision programs, community service orders, work-release centers, electronic monitoring, probation, or other alternative measure programs (John Howard Society of Alberta, 1998). Each of these community-based correctional programs poses significant benefits to alleviating the correctional facilities problem with them experiencing just too many inmates. The bail supervision programs release the offender to a member of the community, while that person is awaiting trial. This program not only holds the offender accountable for not screwing up while awaiting trial, it also holds someone else accountable for those people’s actions as well. Many times this takes place in the form of bail or following the release of an offender on recognizance also known as RoR. Community service is another fine example of the serving of punishment. This program allows offenders to give back to the community by means of working within the community. Many times community service takes place at a local store such as the Youth Ranch, other times it will be strictly with the city or county, doing things such as working at the local landfill, or cleaning court offices and other associated buildings. Offenders in this program, report at a scheduled time to the jail and receive their daily work assignment, form that point until the remainder of their day, they work under the supervision of the jail staff. Work release centers offer the opportunity for inmates to leave the facility to fulfill work schedules obtained prior to sentencing. Most inmates must pay a higher fee for this opportunity but can have someone approved by the facility to transport the inmate to and from work, however, the inmates are also subject to random checks by authorities to ensure they are accounted for at all times. Future Trends and Issues As time continues to evolve, the judicial system is bound to encounter the continuation of trends as society is beginning to see in both past and present times. It impossible for one to say what will or will not happen to the future correctional facilities, but through monitoring of the past, one can begin to see a devastating trend form. By removing the rehabilitation aspect and imposing the punishment aspect, the system continues to enable the cycle, thus bringing it to the point it is today. Research suggests that the trends both courts and facilities will face include that of continued prison growth as well as the potential for early release patterns (The Sentencing Project, n.d.). By the courts handing down sentences strictly for a punishment reason, they are enabling the continuation of a growth that already exceeds maximum capacity within the facilities. A suggestion to combat this scenario and alleviate the congestion within the facilities is to take advantage of the community-based programs available for offenders who do not pose a significant threat to themselves, or to society. The punishment aspect of the crime is satisfied by the courts and the chances of rehabilitation are greater in this case than they would be, compared to taking advantage of the smaller programs available while in jail. This scenario plays on with the second possible trend that if offenders are still sent to the correctional facilities, not only will the continuation of over crowdedness still be in place but also eventually something will have to take place to correct it. The something will have to include releasing certain inmates earlier than intended by the courts, thus risking the safety of not only others in society but also the released inmates, and increasing the possibility of recidivism. Conclusion This paper covers many trends in the public and institutional criminal justice system. These trends, starting from the past, push the research into the present and future with the implementation of continuing trends and perspective ideations to aid in the progress and advancement of criminal procedures. The first section of this paper covers the history of the commercial criminal justice and follows it up through the present-day. Gender Discrimination Essay

Laws on woman’s rights have changed a lot since the 1900’s. Women weren’t allowed to vote, get an education, and have high authority in jobs. Now, women are allowed to do all of these things and more. But have things really changed, or are they just more hidden? There are three ways in which women are discriminated against: in the workplace, television, and in politics. According to Napoleon Bonaparte â€Å"Nature intended women to be our slaves they are our property. Woman are nothing but machines for bearing children. Even though Napoleon is dead, and has been for a while now, this way of viewing women is very much alive. Why is it that woman are paid less than men for doing the same jobs? For example, a male professional basketball player gets paid way more than a woman. A 2008 study of 63 countries shows that a woman in the same job as a man with the same responsibilities is paid 10% to 15. 6% less then the man. Television plays a big part on the way that our country views woman. For example, in a commercial for pizza bites you see a women coming home from the grocery store with pizza bites, and making them for her children. Why is it that a man is never shown in the kitchen cooking for his children? Another example is on the show George Lopez. George manages an airplane parts factory, while his wife is a stay at home mom. The only thing you ever see her doing in this show is cooking, taking care of her kid, or arguing with her mother-in-law. In conclusion, women are stereotyped when cast for television roles. Television only shows woman, cleaning cooking, or taking care of their children. When it come to politics people can be very unwilling to change. For example we have never had a woman vice president or president. Each time we have a women run for president, I become more aware of gender discrimination in this country. Men will not vote for a woman candidate simply because she’s a woman. I had once seen a shirt stating: â€Å"No women will ever be president because: 1. No woman is a man. 2. See rule 1†. There has never been a women president because men in politics who vote are so unwilling to make a decision without discriminating against woman. Until America changes as a whole discrimination against woman will continue. Even though we women would like to believe otherwise they are still discriminated against: in the workplace, television, and in politics. The only way for women to be truly equal in this country is for women to get the same salary as men in careers, television to stop stereotyping women, and for America as a whole to change the way they view women, and the way they teach their children about the roles of women in society. Until this happens, women will always be discriminated against.

1. How did the court determine that the offer was sufficiently definite? The offer of the Wells Fargo Business Credit, Inc. was submitted to Nebraska Beef in the form of a letter. When Nebraska Beef engaged in accepting a line of credit from Wells Fargo they entered into a written credit agreement that outlined the terms of the line of credit and the over-advance which contained additional and progressive fees for each additional over-advance loan (the amount over the initial credit limit). With each of the three over-advance lines of credit or advances of money that Nebraska Beef took out with Wells Fargo, a formal written amendment to the original credit agreement was provided. Thus even though there were no new agreed upon terms, it is a sufficiently definite agreement in that Nebraska Beef evidenced their acknowledgement of additional fees through these three previous advances and further they acknowledge receipt of information stating these additional fees. In fact it was stated in the case that â€Å"an offer may be inferred wholly or partly from words spoken or written or from the conduct of the parties or a combination thereof.† In this case clearly the conduct of Nebraska Beef indicates an acknowledgement of additional fees based on their previous advances and the associated fees. In the May advances, Wells Fargo simply charged the same additional fees as were in place in the third advancement and then at the end of the month (23rd) they sent a letter that Nebraska Beef acknowledges receiving; outlined the increase of the advancement fees. Nebraska beef continued to take advances throughout May and in this regard the offer was not only sufficiently definite but a unilateral contract existed (a promise for performance). 2.How did Nebraska Beef indicate its acceptance? The Nebraska Beef ultimately engaged in an a agreed contract or ‘acceptance’ of the terms through their action of accessing or taking funds through the over-advance program and thus made Nebraska Beef subject to additional fees through the provisions of the additional amendments. Nebraska Beef accepts by using the money offered through the over-advance by Wells Fargo and continuing to take multiple options of the over the credit line-advances. This is ‘accepting’ the terms of the contract because they exercised their right to the funds and in doing so ‘accept’ the terms of the advance which include additional fees. Chapter 14: Register.com, Inc. v. Verico, Inc. Case Concept Review: 1.Why did the court conclude that Verio accepted the terms of the legend? In this case the court ruled that Verio received daily notices of the conditions of the legend. This implies Verio accepted the terms of the legend at the very least after his initial use, because he continued to access and use the data after the fact of the notice. Although the initial use produced terms after he accessed the WHOIS data and was potentially unaware that the register had conditions for the use of the data until after he received it, Verio admits to being aware of the conditions after the first use and continued to access the data several times a day and repeatedly was sent the notice of the terms of the conditions thereafter. The conditions were prov ided in writing and Verio continued to use this service therefore, his actions demonstrate acceptance of the terms. 2.In another section of the opinion, the court stated that there was no reason why Verio be required to â€Å"click† acceptance of the terms? Based on the material presented above, why do you believe that the court did not impose a â€Å"click† requirement? It does seem as though a ‘click’ requirement would have kept the case out of court, however, as demonstrated in the material and the information provided above, the result would not have been different. Essentially, I believe the court did not impose a ‘click’ requirement because the term notifications are sent to the businesses making the data inquiries and after the data is received notifications for terms of the acceptable use of the data are provided in writing to the businesses. Therefore, by accessing and accepting the data, the actions of the business demonstrate an acceptance to the outlined conditions and therefore no ‘click’ is required. Using the data has certain provisions that are outlined in written notices and companies accepting the data are subject to complying with these provisions. There is an offer to provide the data with provisions for use and acceptance to receive the data and comply with their written acceptable use polic y. ~No click necessary. Chapter 15:Louisa W. Hamer v. Franklin Sidway, as Executor, etc. Case Concept Review: 1. What did the nephew promise? The nephew promised to keep from drinking and smoking, swearing, and playing cards or billiards for money until his twenty first birthday in exchange for a payment of $5000 from his uncle. The $5000 was to be paid to the nephew by the uncle after he turned twenty-one, if he refrained from all of the above actions during the time period prior to turning twenty-one. In this case the nephew kept his promise and his proper execution of the agreement was acknowledged by the uncle in a written correspondence. 2. Why was the nephew’s promise sufficient to qualify as consideration? The nephew’s promise was sufficient to qualify as consideration because in order for there to be consideration, there has to be detriment. In this case, the court ruled that there was detriment to the nephew because he had to give up his right to freely engage in smoking and drinking and in promising to do that he is stating he is giving up this right and accepting the offer and in executing the acceptance he can’t smoke or drink which is something he had not been formally obligated to do (thus constituting a detriment). He had a right to drink, smoke, swear or play cards or billiards for money and he was served a detriment by giving up this right and entering into the agreement with his uncle to forgo these options. The other element in consideration would be the legal benefit that is gained. This occurs when something is received that the party did not have a former legal right to receive. In this case the judge found that the uncle (who made the promise to pay) was benefited â€Å"in a legal sense.† The courts further stated that â€Å"it is enough that something is promised, done, forborne or suffered by the party to whom the promise is made as consideration for the promise made to him.† Additionally, the uncle wrote back acknowledging that the nephews promise was adequately executed per the terms of the agreement and per the nephew and uncle’s agreement, the nephew was entitled to the sum of money promised to him ($5000).There was acknowledged and agreed upon, full performance of the promise. The case was fairly straightforward once it was established that in fact consideration was met in the case.

What is that makes us human beings and not animals? Is it where we come from and what we have or self-control of our wants and needs? To what extent are we ready to go to gain power that we no longer remember who we are! Jay Gatsby from F. Scott Fitzgerald’s novel The Great Gatsby will be able to answer these questions to us. Jay Gatsby, a year or two over thirty, was a mysterious persona. He lived in West Egg, Long Island and was greatly known in the locality for his lavish parties that housed both the invited as well as the uninvited. With extravagant cuisine, rich fresh fruits from New York, Vladimir Tostoff’s Jazz and his Rolls Royce moving to and fro picking up guests, Jay Gatsby threw big parties. He used the phrase ‘old sport’ very often while addressing everybody. His picking of words with care only showed some fishiness regarding his identity. By calling himself an Oxford Educated and wealthy person without any family, he camouflaged his true identity and was a liar. Jay Gatsby, was truly James Gatz a nobody from North Dakota whose parents were unsuccessful farm people. Gatsby’s humiliation of being poor and a man without any class increased his hunger for power and he didn’t care how he got it. â€Å"Contemporary legends such as the â€Å"underground pipe-line to Canada. attached themselves to him, and there was one persistent story that he didn’t live in a house at all, but in a boat that looked like a house and was moved secretly up and down the Long Island shore† (Fitzgerald) only establishes the fact that his business was unethical and notorious. He was a bootlegger and had various links to people like Wolfsheim. His current attitude and outlook that showed off his wealth and dignity was certainly not inherit ed as he worked as a janitor and was a drop out from St. Olaf’s college in Minnesota. Unhappy about his poverty and class, â€Å"he invented just the sort of Jay Gatsby that a seventeen-year-old boy would be likely to invent, and to this conception he was faithful to the end. † (Fitzgerald) His belief that money and power could accomplish anything and change the past, only portrays his blatant attitude that led to conceal his true identity and he thus showed off his wealth through his parties despite that fact that it mostly invited fake people. Madly in love with Daisy, a beautiful woman who was married to the Tom Buchanan, Gatsby hoped to win her back and thus kept throwing those wonderfully big parties. His world and life revolved around the dream of winning back his love Daisy. â€Å"Gatsby buys his West Egg mansion with the sole intention of being across the bay from Daisy Buchanans green light at the end of her dock, a fantasy which becomes Gatsbys personal version of the American Dream† (Novel Analysis). Having his emotions bottled up for Daisy for so many years, it became a burning passion in his heart, made him very obsessive. He used richness and wealth to lure her back to him. His love for Daisy had blinded him to the fact that she had left him for a man with solid position, wealth and prosperity which was another reason in his life to become rich. He idolized her and he felt married to her and wanted her back at any cost even though she killed Myrtle-Tom’s lover while driving Gatsby’s car. Having lived the life the way he want and working towards achieving his goal and dream, Jay Gatsby is that legend with whom we can relate ourselves. We all have wants and desires. But his desire for Daisy only led to his downfall. Misguided by his belief and seeking vengeance for Myrtle’s murder, Myrtle’s husband George killed Gatsby in his own pool thinking that it was Gatsby who murdered his Myrtle which in reality was Daisy! A funeral with only few friends and his father Henry Gatz and none of the fake people who attended his parties, nor Daisy for whom he was killed, Jay Gatsby’s life only portrays that it is not money that maketh man, it is his values and ideals. It is not what we want, but why we want something and a constant check on the direction we are going makes us who we are!
